These terms are an agreement between you and Reuleaux Inc ("we") about Rory: the app, its calls and this site. By using Rory you agree to them, and to how we handle information in our privacy policy.
They include an agreement to settle disputes one person at a time through arbitration, not in court and not in class actions (see Disputes). You can opt out of it within 30 days.
You must be 18 or older. Use a phone number that's yours, and keep your account to yourself.
Rory places phone calls at the times you choose, with AI characters who talk with you: to get you up, and for the other calls you set up. The callers are AI, not people. They can mishear you, get things wrong or say something odd. If a caller says something that seems wrong or unsafe, don't act on it. If you pick the roast tone, your caller teases you; you can switch to kind any time.
Phones, networks and settings can stop a call from ringing or connecting, and the services we rely on can go down. Don't rely on Rory alone for anything where a missed or late call could hurt you or someone else, or cost you something that matters. Keep a backup alarm for those.
Rory helps people get up and do what they planned. It doesn't diagnose, treat or prevent ADHD, sleep problems or any other condition, and nothing a caller says is medical advice. Medication calls are reminders you set up yourself: follow your doctor's and pharmacist's instructions, not the caller. In an emergency, call 911.
You agree that we may call the number on your account with automated AI voice calls at the times you set, and text it sign-in codes. Say "stop" on any call, or use the stop page, and we won't call it again. Your carrier's rates may apply.
Only invite a friend who knows you're inviting them. They agree on their own link before we call them, and they can say "stop" too.
What you type, say and add, like your plans, call requests, screenshots and the messages friends send you, stays yours. You let us use it to run and improve Rory, including sending it to the companies in our privacy policy that run the calls. Only add what you have the right to share.
Don't use Rory to call or bother anyone who hasn't agreed, to harass anyone, or to break the law. Don't get around its limits, copy or take apart the app, overload it, or use it or what callers say to train AI models. We can limit, suspend or close accounts that do.
Plans are sold through the App Store and billed by Apple to your Apple Account. A plan renews automatically at its price until you cancel, at least 24 hours before it renews, in your iPhone's Settings: tap your name, then Subscriptions. A free trial becomes a paid plan unless you cancel before it ends, and each person gets one. Deleting the app or your account doesn't cancel a plan.
Apple handles refunds, and we can't give them: ask Apple at reportaproblem.apple.com. If a price changes, Apple tells you first, as its rules require. Offer codes, like a creator's, are Apple offers with their own terms, and we can end an offer for new people at any time.
If you got Rory from the App Store, Apple's Licensed Application End User License Agreement covers your license to the app, alongside these terms. These terms are between you and us, not Apple. Apple has no duty to support or maintain the app and isn't responsible for claims about it. Apple and its subsidiaries can enforce these terms as third-party beneficiaries.
You can delete your account any time in the app's Settings. We can suspend or close an account that breaks these terms, or stop offering Rory; if we stop it, we'll tell you first when we can. The parts of these terms that should last after an account ends, like Disputes and the limits on liability, still apply.
We may update these terms. If a change matters, we'll tell you in the app before it applies, and using Rory after that means you accept it. A change to Disputes never applies to a dispute we already knew about.
Rory is provided as is and as available. As far as the law allows, we make no promises beyond these terms, including that every call will connect, ring on time or get you up, or that what callers say will be right.
As far as the law allows, we aren't liable for indirect, incidental, special or consequential losses, such as being late, a missed dose, lost earnings or lost data. Our total liability for all claims about Rory is limited to the greater of what you paid for it in the 12 months before the claim, or $100.
Some places don't allow these limits, so they apply only as far as the law where you live allows.
If someone makes a claim against us because you broke these terms or the law while using Rory, such as inviting a number without its owner's say so, you'll cover our reasonable costs from it, including lawyers' fees.
Talk to us first. Email help@reuleaux.app with your name, the phone number on your account, what happened and what you'd like. We'll try to sort it out within 60 days, and neither of us starts a case before then. Time limits for claims pause meanwhile.
Then arbitration, one person at a time. If we can't sort it out, you and we agree to resolve any dispute about Rory or these terms by binding individual arbitration with the American Arbitration Association under its Consumer Arbitration Rules, instead of in court. There's no judge or jury, and the arbitrator's decision is final, but the arbitrator can award you the same individual relief a court could. We pay the filing and arbitrator fees beyond what those rules ask a consumer to pay. Hearings can be by phone or video, or in the county where you live.
No class actions. Claims can only be brought individually, never as a plaintiff or class member in a class, collective or representative action, and an arbitrator can't combine different people's claims. If this paragraph can't be enforced for a claim, that claim goes to court instead, after any individual arbitration is done.
Many similar claims. If 25 or more similar claims are filed against us by the same or coordinated lawyers, they're handled in batches under the AAA's Mass Arbitration Supplementary Rules, and time limits pause for the claims waiting their turn.
What's left out. Either of us can take an individual claim to small claims court instead, and either of us can go to court to stop misuse of intellectual property.
You can opt out. Email help@reuleaux.app within 30 days of first agreeing to these terms, saying you opt out of arbitration, with the phone number on your account. Nothing else in these terms changes if you do.
The Federal Arbitration Act governs this section. As far as the law allows, a claim must be brought within one year after it arises.
If you live in Canada. Where the consumer protection law of your province doesn't allow it, as in Quebec and Ontario, this section's agreement to arbitrate and its waiver of class actions don't apply to you, and you can bring a claim in the courts where you live.
These terms are governed by the laws of the State of Delaware and of the United States, leaving aside rules about which law applies. Anything that goes to court under these terms is heard in the state or federal courts in Delaware, apart from small claims. If you live in Canada, nothing in these terms takes away the protection the consumer law of your province gives you.
If part of these terms can't be enforced, the rest still applies. Not enforcing a part right away isn't giving it up. You can't transfer these terms; we can, as part of a merger or sale. These terms and the privacy policy are the whole agreement about Rory.
